Permanent occupations of land by such installations as telegraph and telephone lines, rails, and underground pipes are takings if required by regulation; and even if they occupy only relatively insubstantial amounts of space and do not seriously interfere with the landowner’s use of the rest of the land.
The right to exclude is one of the most essential sticks in the bundle of property rights.
